The following words and phrases, whenever used in the ordinances of the city of McMinnville, Oregon, shall be construed as defined, in this section unless from the context a different meaning is intended or unless a different meaning is specifically defined and more particularly directed to the use of such words or phrases:

A. “Alley” means a street which affords only a secondary means of access to property.

B. “City” and “town” each mean the city of McMinnville, Oregon, or the area within the territorial limits of the city of McMinnville, Oregon, and such territory outside of the city over which the city has jurisdiction or control by virtue of any constitutional or statutory provision.

C. “City manager” means the individual having general supervision of the administrative affairs of the city and general control over all nonelective officers and employees of the city excepting those of the water and light department and municipal judge, and any reference to the city administrator and/or the administrative assistant refers to the same individual.

D. “Council” means the common council of the city of McMinnville. “All its members” or “all councilmen” means the total number of councilmen holding office.

E. “County” means the county of Yamhill.

F. “Law” denotes applicable federal law, the Constitution and statutes of the state of Oregon, the ordinances of the city of McMinnville, and, when appropriate, any and all rules and regulations which may be promulgated thereunder.

G. “May” is permissive.

H. “Month” means a calendar month.

I. “Must” and “shall” are each mandatory.

J. “Oath” means and includes an affirmation or declaration in all cases in which, by law, an affirmation may be substituted for an oath, and in such cases the words “swear” and “sworn” shall to be equivalent to the words “affirm” and “affirmed.”

K. “Owner,” applied to a building or land, means and includes any part owner, joint owner, tenant in common, joint tenant, tenant by the entirety, of the whole or a part of such building or land.

L. “Person” means and includes a natural person, joint venture, joint stock company, partnership, association, club, company, corporation, business, trust, organization, or the manager, lessee, agent, servant, officer or employee of any of them.

M. “Personal property” means and includes money, goods, chattels, things in action and evidences of debt.

M.5. “Police officer” means an officer of the McMinnville police department who is employed full-time as a peace officer and commissioned by the city to be responsible for enforcing the criminal laws of this state, including the execution of arrest and search warrants, and laws and ordinances of the city. The officer must be certified or eligible for training and certification by the state of Oregon Board on Police Standards and Training (BPST) pursuant to applicable Oregon Revised Statutes and BPST Administrative Rules.

N. “Preceding” and “following” mean next before and next after, respectively.

O. “Property” means and includes real and personal property.

P. “Real property” means and includes lands, tenements and hereditaments.

Q. “Sidewalk” means that portion of a street between the curbline and the adjacent property line intended for the use of pedestrians and developed with a paved surface.

R. “State” means the state of Oregon.

S. “Street” means the entire width between the boundary lines of every dedicated public way which provides for public use for the purpose of vehicular and pedestrian traffic and the placement of utilities and including the terms: Road, highway, drive, lane, place, avenue, alley, cul-de-sac or other similar designation.

T. “Tenant” and “occupant,” applied to a building or land, mean and include any person who occupies the whole or a part of such building or land, whether alone or with others.

U. “Written” means and includes printed, typewritten mimeographed, multigraphed, or otherwise reproduced in permanent visible form.

V. “Year” means a calendar year unless otherwise specifically enumerated. (Ord. 4485 §1, 1991; Ord. 3994 §1, 1979).
