A. Application for parade permits shall be made to the chief of police at least ten days prior to the intended date of the parade, unless the time is waived by him.

B. Applicants shall include the following information:

1. The full name, date of birth, Oregon driver’s license, Social Security number, address of the applicant, and telephone at which he can be reached;

2. The date and beginning and ending times of the parade;

3. The desired route, including assembling and disassembling points;

4. The approximate number of persons, vehicles and animals which will be participating in the parade;

5. The applicant or individual in charge of the parade shall sign the parade application;

6. Security and supervision plans for the parade and its participants.

C. The chief of police, upon receipt of the application, shall determine if the parade can be conducted without endangering the public safety and without seriously inconveniencing the general public. The following factors shall be considered in making his decision:

1. Whether the applicant or individual in charge of the parade has in the two-year period immediately preceding the application been convicted of a crime involving assault, menacing, harassing, or other crime which illustrates a behavior characteristic that would endanger the safety or the general public, or demonstrates a lack of ability or willingness to supervise the parade so that no violations of the law occur;

2. Security and supervision to be provided by the applicant;

3. Any previous history relating to the manner in which the applicant supervised and conducted a parade.

4. Providing false information on the application form;

5. Whether the city can provide sufficient police to provide security, direct traffic and perform such other duties as may be necessary. (The chief shall also take into consideration the police budget, time, place, duration of the parade and number of police officers available for duty, all in relation to the safety and general well-being of the citizens of McMinnville.)

D. If the chief of police determines that the parade cannot be conducted without endangering public safety or seriously inconveniencing the general public, he may:

1. Propose an alternate route;

2. Propose an alternate date.

3. Refuse to issue a parade permit.

E. The chief of police shall notify the applicant of his decision within five days of receipt of the application.

F. If the chief of police proposes alternatives or refuses to issue a permit, the applicant shall have the right to appeal his decision to the common council.

G. The decision of the police chief as regards a parade permit shall be reviewed and approved or denied by the city manager prior to the issuance of any permit. (Ord. 3989 §1, §2, 1979; Ord. 3629 §75, 1972).
