If any person or persons fills up or obstructs any ditch or drain provided for in this chapter, or builds any bridge, culvert or passageway over the same in any manner other than provided by the terms of this chapter, he is guilty of a misdemeanor and upon conviction thereof before the recorder of the city shall be punished by the payment of a fine of not less than five dollars nor more than $25.00 together with the costs of prosecution, and in default of payment thereof shall be imprisoned in the city jail one day for each $2.00 of such fine so imposed.
