A. Notwithstanding ORS 153.018(3), a violation of Section 5.36.030 by a restaurant or retail establishment, as those terms are defined in Section 5.36.010 is a Class D violation subject to a maximum fine of $250.00 for the first violation in a calendar year; subject to a maximum fine of $300.00 for a second violation in the same calendar year; and subject to a maximum fine of $500.00 for any subsequent violation within the same calendar year.

B. Each day that the restaurant or retail establishment commits a violation constitutes a separate offense. (Ord. 5083 §1 (Exh. A (part)), 2019).
