A. Second-hand merchants shall communicate the information from each purchase report form to the McMinnville police department or to any other location specified by the police chief no later than the end of the third day immediately following the day the transaction recorded on the purchase report form occurred. The purchase report form is subject to public disclosure pursuant to Oregon Public Records Law. Trade secrets contained in the report forms will be protected to the full extent allowed by the Public Records Law.

B. The police chief may designate the method used for the communication of information from purchase report forms and may direct that it be communicated by means of an automated electronic reporting system.

C. Only communications containing complete information shall be deemed to comply with this section.

D. In the event that the automated electronic reporting system becomes inoperable, a second-hand merchant’s computer system becomes inoperable, or any other event occurs that makes reporting within the time required by subsection A of this section impossible, the second-hand merchant shall immediately report the occurrence of such event to the police chief. The police chief may require paper reports until electronic reporting can resume. The merchant will ensure that these paper reports are received by the police department within three business days from the date of the transaction. Once the police chief determines that electronic reporting can resume, second-hand merchants must, within 12 hours, input and transmit the information required under subsection A of this section for all purchases made during any period when the use of paper reports was allowed by the police chief. Exceptions to this 12 hour requirement may be requested and granted on a case by case hardship basis.

E. If, after establishing the method and requirements for the communication of information from purchase report forms, the police chief alters the method or requirements, second-hand merchants will be given at least 60 days to comply with the new method or requirements. If unable to implement the reporting system before the deadline, a second-hand merchant must submit a written request for additional time to the police chief before the deadline. (Ord. 4950 §3, 2012).
