A. Violation of a provision of this ordinance by a person who owns, manages, operates, or shares in the ownership, management, or operation of a second-hand business shall be grounds to revoke any second-hand merchant permit issued to that second-hand business.

B. Violation of a provision of this ordinance by a person shall constitute a public nuisance and may be subject to abatement in accordance with the provisions of McMinnville Municipal Nuisance Code.

C. The penalties imposed by this section for violation of this ordinance are in addition to and not in limitation of any other action or claim available to the city or any other governmental jurisdiction.

D. Any violation of this ordinance is punishable, upon conviction, by a fine of not more than $1000 and a jail sentence of up to 90 days.

Section 4. Sunset provision repealed by Ord. 4965 §2, 2013.
