A. It is unlawful for any person to knowingly commit any of the following:

1. Provide contract security services without possessing a valid license or registration;

2. Employ any individual to perform the duties of an armed private security officer who is not the holder of a valid temporary permit or registration card;

3. Publish any advertisement, letterhead, circular, statement or phrase of any sort which suggests that the licensee is an official police agency or any other agency, instrumentality or division of this state or of this county, or any of its political subdivisions or of the federal government;

4. Issue any metal badge or shield;

5. Designate an individual as a private policeman and/or private officer;

6. Knowingly make any false statement or material omission in any application filed with the licensing authority;

7. Falsely represent that the person is the holder of a valid license;

8. Carry a firearm in performance of his duties if not the holder of a valid armed private security officer registration card or temporary permit;

9. Make any statement which would reasonably cause another person to believe that the private security officer is a sworn peace officer or other official of this state or this county or of any of its political subdivisions or agency of the federal government;

10. Fail to comply with the regulations issued by the licensing authority or with any other requirements under the provisions of this chapter;

11. Fail to return to the licensee or the licensing authority a registration card or temporary permit immediately upon its invalidation or expiration;

12. Possess a license, registration card, temporary permit or identification card issued to another person;

13. Use any metal badge or shield.

B. The violation of any of the provisions of this section unless otherwise specified shall constitute a misdemeanor punishable by fine of not more than five hundred dollars or up to six months imprisonment, or both.

C. This chapter shall in no way be a substitute for nor eliminate the necessity of conforming with any and all state laws, rules and regulations, and other city ordinances which are now or may be in the future in effect which relate to the activities regulated in this chapter. (Ord. 3824 §10, 1976).
