It is a violation of this chapter for the owner or keeper of a dog to do any of the following:

A. To have a dog running at large;

B. To allow a dog to become a public nuisance, except that a dog shall not be considered a public nuisance under this chapter if the dog bites a person who is wrongfully assaulting the dog or the dog’s owner, or if the dog bites a person trespassing on the premises occupied by the dog’s owner, and has been provoked by that person;

C. To keep a dog with knowledge that it has injured other domestic animals;

D. To keep a dog without a license attached to its collar, as required by this chapter, when that dog is subject t the licensing provisions of this chapter;

E. To keep an unlicensed dog, when that dog is subject to the licensing provisions of this chapter or the county;

F. To keep a dog which has not received its rabies inoculation as required under ORS 433.365. It shall be an affirmative defense to a violation of this provision that the dog was inoculated prior to trial, and the charge shall be dismissed upon the presentation to the trial court of a certificate of inoculation signed by a veterinarian;

G. To refuse to surrender a dog which has bitten a person when that dog has not been effectively inoculated against rabies, or the owner or keeper of any animal suspected to have rabies to refuse to surrender the animal to a dog control officer upon demand;

H. To have a vicious dog go unconfined;

I. To fail to display in a prominent place on his or her premises a clearly visible warning sign indicating that there is a vicious dog on the premises. A similar sign is required to be posted on the pen or kennel of the animal. In addition, the owner shall conspicuously display a sign with warning symbol that informs children of the presence of a dangerous dog;

J. To possess or harbor or maintain, or care or have custody of any dog for the purpose of dog fighting; or to train, torment, badger, bait or use any dog for the purpose of causing or encouraging the dog to attack human beings or domestic animals;

K. To locate a pen or structure (or any part thereof) to confine a vicious dog closer than 20 feet from a sidewalk, street, or alley. (Ord. 4420 §1 (part), 1988).
