In all cases where any street, avenue, alley or roadway is brought to an established grade and improved by macadamizing or graded for dirt roadway only, there shall be fixed and established at either side of such street, alley, avenue or roadway so graded or improved, and at location to be fixed and established by the city engineer, at or near the proposed curbline, and adequate and suitable ditch or other drain for carrying away the surface water accumulating upon such street, avenue, alley or roadway, with proper slope from the paved portion of such street to such drain. The drain when so fixed, constructed and established shall be maintained from time to time without obstruction thereof so as to properly and adequately drain the street, avenue, alley or roadway for which the same has been so prepared.
