A nonprofit organization may provide its own dance security provided an individual has been approved by the chief of police to perform this service. The application procedure is:

A. The nonprofit organization shall submit to the chief of police the following evidence (under oath or affirmation) and satisfactory to the chief of police that the applicant meets at least the following requirements:

1. Be of legal age;

2. Be a citizen of the United States or a resident alien;

3. Not have been convicted in any jurisdiction of any felony or any crime involving moral turpitude or illegally using or possessing a dangerous weapon for any of which a full pardon has not be granted;

4. Not have been declared by any court of competent jurisdiction incompetent by reason of mental difficulty or disease, and has not been restored;

5. No suffering from habitual drunkenness or from narcotics addiction or dependence;

6. Be of good moral character;

7. List at least three character references and a history of his work record;

8. List his experience and training which relate to security services;

9. File a current photograph of the applicant.

B. The chief of police shall complete a background investigation and issue a special security permit for the individual to provide dance security only to the nonprofit agency submitting said request.

C. The chief of police may deny an application if any of the following circumstances exist:

1. When the applicant has been convicted of a crime the nature of which indicates a lack of ability to conduct and supervise a public dance so that one may reasonably expect that no violations of the law will occur. An example of such a crime would be theft, fraud, disorderly conduct or any crime of violence or a crime relating to a controlled substance, any of which has occurred in the previous five years;

2. Any previous history relating to the manner in which the applicant supervised and conducted a dance which resulted in violation of the law;

3. Providing false information on the application form;

4. Absence of appropriate security;

5. Such additional reasons as affect the safety and well-being of the citizens of the city.

D. In the event the chief of police refuses to issue a license, his decision may be appealed to the city council.

E. All applications for a special nonprofit security permit must be filed not less than ten working days before a scheduled event. (Ord. 4343 §2, 1985; Ord. 3961 (part), 1978).
