As used in this chapter, the following terms shall be defined as follows:

A. “Animal” means any mammal, bird, reptile or amphibian kept as a domestic pet.

B. “Bail” means money or its equivalent deposited by defendant to secure his appearance in court for a dog control offense.

C. “Barking dog” means any dog that disturbs any person by frequent or prolonged noises.

D. “Cruelty to animals” means the infliction of physical pain, suffering or death upon any animal, when not necessary for purposes of training or discipline, except for the putting to death of animals by a licensed veterinarian or other authorized organization.

E. “Dog” means any mammal of the canine family.

F. “Dog facility/dog kennel” mean any site where four or more dogs of licensable age are kept, whether such anima are the property of the site owner or other persons; provided, however, dogs kept as household pets shall not be count for the purpose of determining whether a “dog facility” exists.

G. “Dog license” means that license required to be is sued annually for each individual dog, pursuant to the provisions of Ordinance No. 150 of Yamhill County.

H. “Dog running at large” means a dog off or outside the premises of the owner, not restrained by a rope, line leash, chain or other similar means and not under the control of a capable person.

I. “Owner” means any person 18 years or older, firm, corporation, organization or department possessing or harboring or having the care of custody of a dog.

J. “Public nuisance” means a dog that does any of the following:

1. Bites a person;

2. Chases vehicles or persons;

3. Damages or destroys the property of persons other than the owner of the dog;

4. Trespasses on private property of persons other than the owner of the dog;

5. Disturbs any person by frequent or prolonged noises;

6. Dog running at large, and owner convicted of three previous offenses within 12 months.

K. “Unconfined vicious dog” a vicious dog is “unconfined” if the dog is not securely confined indoors or confined in a securely enclosed and locked pen or structure suitable to prevent the entry of young children and designed and built to standards to prevent the animal from escaping. Such pen or structure shall have secure sides and a secure top and shall also provide protection from the elements.

L. “Vicious dog” means:

1. Any dog with a known propensity, tendency or disposition to attack unprovoked, to cause injury to, or otherwise threaten the safety of human beings; or

2. Any dog which, without provocation, attacks or bites, or has attacked or bitten, a human being or domestic animal; or

3. Any dog owned or harbored primarily or in part for the purpose of dog fighting, or any dog trained for dog fighting. (Ord. 4420 §1 (part), 1988).
