A. Fines shall be imposed as follows:

1. For a violation of MMC 6.04.150(A), a fine not to exceed $250.00. The fine for the first offense shall be not less than $5.00, for the second offense and thereafter, not less than $25.00; provided, that said second offense occurs within the succeeding 12-month period;

2. A violation of MMC 6.04.150(B) shall be punishable by a fine of not more than $25.00 for the first violation, or not more than $100.00 for each additional violation, and to make restitution for any property damaged. In addition to any fines and restitution, if the dog has been repeatedly as shown by convictions of this or any other court) found to be a public nuisance as defined in this chapter, the court may order such disposition of the dog that the court considers necessary for the safety or health of the public, except a dog that has bitten a human may be ordered destroyed by the court upon the first instance of such behavior;

3. For a violation of MMC 6.04.150(C), a fine not to exceed $250.00;

4. For a violation of MMC 6.04.150(D), a fine not to exceed $250.00;

5. For a violation of MMC 6.04.150(E), a fine not to exceed $500.00;

6. For a violation of MMC 6.04.150(F), a fine not to exceed $500.00;

7. For a violation of MMC 6.04.150(G), a fine not to exceed $500.00;

8. For a violation of MMC 6.04.150(H), a fine not to exceed $500.00; the court may order such disposition of the dog that the court considers necessary for the safety or health of the public;

9. For a violation of MMC 6.04.150(I), a fine not to exceed $500.00;

10. For a violation of MMC 6.04.150(J), a fine not to exceed $500.00;

11. For a violation of MMC 6.04.035, a fine not to exceed $100.00 for each day that insurance, a surety bond, or a cash deposit is not provided as required in subsection b this section;

12. For a violation of MMC 6.04.150(K), a fine not to exceed $100.00 for each day that said pen or structure continues in violation of this chapter.

B. The penalties described in this section shall be in addition to any charges assessed against the owner or the keeper of any animal under this chapter for the licensing, impoundment and maintenance of said animal.

C. A trial shall be before the court without a jury and no appeal of the decision may be taken. (Ord. 4420 §1 (part), 1988).
