The noise Control Act of 1972, as adopted by the U.S. Congress, expressed the opinion that primary responsibility for control of noise rests with state and local governments. The ordinance codified in MMC 9.32.050 through 9.32.090 is adopted in consonance with this principle and for the purpose of securing for the citizens of the city an environment which is protected from unnecessary noise generated by railroad activities occurring within the city. The regulations proposed in MMC 9.32.050 through 9.32.080 are enacted under the police power of the city to protect the health and general well-being of all citizens by regulating those local railroad activities which interfere with the health, general well-being, hone life and natural right to peace and quiet during the normal sleeping hours of 11:00 p.m. to 6:00 a.m. (Ord. 3877 §1, 1977).
